City of Montreal (Arrondissement du Plateau Mont-Royal) and Société de Développement commercial de l’avenue Mont-Royal (SDC)

SETTLEMENT DATE – JULY 2011

The complainant lives in the borough, which is very lively during the summer season, in particular with its sidewalk cafes and its beautiful new kind of counter-terraces, which are erected on a platform varying from 15 to 30 centimeters high.

She considers it completely discriminatory and sends letters after letters to the borough, which does not seem to take it seriously. She ends up sending a formal notice and as she still does not receive a response, in August 2010, she files a complaint with the CDPDJ.

Two mediation sessions later, the mayor of Plateau Mont-Royal at the time, Mr. Luc Ferrandez, accepted the complainant’s terms, namely to make the 98 terraces of the borough universally accessible.

The architectural firm Provencher Roy won the call for tenders and according to their plan, the borough will impose the accessibility of the terraces as of the summer season 2012. Of these 98 terraces, only 7 have been exempted by the RAPLIQ, because would have presented an excessive constraint because of the little space remaining after the accessibility works.

Payment according to requests. Mediation.
